TERMS OF HIRE

(Elegance Limousines Sydney”, “It”,” The Firm”, are used interchangeably in these Terms of Hire. You may be described as our “client”, “customer”,“ Party” or “the hirer”.)

The following terms CONSTITUTE IMMEDIATE ACCEPTANCE ON RECEIPT. You are not required to sign or return a copy of these terms to be bound by them. Whether these terms are sent to you via electronic, postal or other media Your proceeding with hiring is an implied understanding and acceptance of the following terms. A Presumption of regularity shall apply.

SATISFACTION GUARANTEE Clients travelling must be completely satisfied with the service provided, otherwise please advise of your dissatisfaction and after review of the customers comments, at our discretion, will provide another trip, a pro-rata refund, or full refund depending on the circumstances.

A STRICT NO SMOKING/DRUG POLICY applies in all our limousines, motor coaches, sedans and convertibles.

This includes the prohibition of the use of illicit drugs, narcotic or mind altering substances ,with the exception of those medically prescribed by a physician.

OVERTIME & WAITING CHARGES APPLY These are at per quarter of an hour increments commencing from $25/qtr hour up to $100.00/qtr hour, depending on the make and type of vehicle hired. It is your duty to check with the operator prior to hire, to ensure you fully understand your prevailing rate. (As an example Australian six seater stretched Limousines are from $35/qtr hour, Mercedes 6 pax Limo from $35.00. Lincoln Towncar 10 pax super stretched Limo from $55.00/qtr hour…Ultra super stretch (10 plus 1) seater in back $77/qtr hour…).

CANCELLATION POLICY All Bookings are non cancellable. Exception : where the reservation is cancelled within 48 hours from the time of your original call to our Office and the booking is more than four (4) weeks away. Any Bookings cancelled after 48 hours elapse result in a 20% cancellation fee unless within the four (4) week period prior to the reservation date.. Please Note: That the full hiring fee will be forfeited where a cancellation is effected in the four [4] week period prior to the Limousine/Coach hiring date irrespective of when the reservation time was.

NOTE: All Cancellation Fees incurred can be offset against a future hiring, with a 12-month tenure of expiration.

TIPPING: Is not Obligatory nor Compulsory. Clients may tip if they think the Chauffeur performed an excellent service ,was professional and pleasant.

IMPENDING CONDITIONS You are hereby notified that in the unlikely event of impending conditions (for instance damage to our vehicle en route) Elegance Limousines Sydney and /or any of its associated entities reserves the right to arrange for substitute vehicles, which may not atch the originally requested vehicle. The Firm will make every effort to send its next most similarly featured vehicle to the originally described vehicle ordered, or its next higher grade vehicle (at its option). A pro-rata refund will be made available for a party that receives a lower level grade of vehicle than that which was ordered. The pro-rata refund will be determined, by our Firm in consultation with input from the customer. No refundsare available in instances where a higher-grade vehicle is supplied.

DAMAGE & THEFT We want our vehicle to be enjoyed by all our hiring parties. Hence, Should any of our vehicles INCUR damage, theft, or other monetary loss by any member of the hirer’s party, or guests, we may at our discretion terminate the hire, and/or reserve the right to demand full compensation in respect of such damage. We may hold you “the hirer” jointly or severally liable. If we are of the objective opinion that your actions may be repeated in the future we may suspend until further notice or prohibit on an indefinite basis you and/or any member/s of the offending persons from our Firm and/or any of our associated firms.

CONDUCT: Must NOT be unruly , offensive , or unpleasant at any time. Irrespective of whether it is directed to other member/s of the immediate hiring party, ones self, our Chauffeur or any of our staff or other members of the general public. Our Chauffeur is empowered to terminate the hire in cases of unruly conduct.

PICK-UP TIME We always endeavour to honour our obligation to the hirer with respect to pick up time. However, should our Chauffeur be delayed for any reason which is beyond their immediate control, we shall not be held liable for any difficulties arising out of such delay.

CHARGES, SURCHARGES & CORKAGE We always endeavour to pass on any cost savings to our valued clients. For this reason payment by cash, money order, cheque or direct debit may carry price savings. The charges for the limousine service and any ancillary costs will be detailed below or be explained to you over the phone at the time of your booking. Please Note: That the alteration, adding of extra stops, changing the route, or requesting additional time with the limousine will incur additional charges. To retain discretion the Chauffeurs are not required to inform the passengers or hirer at what point additional charges commence nor are we required to inform the hirer, unless this is specifically requested or unless a ceiling of costs has been set by the original hirer.

ALCOHOL POLICY: A corkage fee of $20.00 per bottle applies to clients travelling who provide their own beverages on the journey. Minors are not permitted to drink alcohol under any circumstances. Alcohol will only be served where all passengers are responsible Adults over 18 years of age. We will not serve alcohol in instances where both Minors and Adult/s are on board, unless prior approval and the Chauffeur determines the Adult will maintain this alcohol policy strictly. Our Chauffeur may cease and remove all alcohol, where in his or her belief their passenger/s are intoxicated or are behaving unruly. Where a Bar * contains boxed or unopened Alcohol, the breaking of a seal ,cork or top constitutes its purchase. Licensing Laws do not permit the removal of bottles from or the purchase of Alcohol for use outside of the nominated vehicle/s hired**.

THE FARE & METHOD OF PAYMENT As detailed above, which we request you familiarise yourself with, costs forming part of the hire fare will be incurred on your journey and form part of your contract and obligation to us. Failure to render payment will result in an evasion of fare and / or further enforcement action being taken by us. Enforcement action may increase the final amount you pay us. In most cases, discharge of a debt can be made by any form of legal tender, or negotiable instrument. Some exceptions exist, for instance, if overtime or waiting time of half an hour is incurred then these must be settled at the conclusion of hire by cash, or credit card only*. (Exception for Approved Account Holders only.) Cheques, Eftpos are not acceptable for on Account Holders.

FANTASY SUPER STRETCHED OR OUR DONALD TRUMP SUPER STRETCHED TYPE LIMOUSINES:

Some vehicles in this range have special exclusive features. These are designed to provide for added enjoyment onboard, You must advise us if you know or suspect anyone in the party suffers from any of the following: Any past history of fits or Epilepsy whatsoever.

You are obligated to advise all members of your party not to stare directly into the emitting laser portal. The Laser can only operate in 15-minute intervals. Optic Fibre six colour change equipment on board some of these Limousines must not be tampered with. It is there for visual enjoyment only. If you tamper or misuse the onboard equipment it will be shut off. Be advised: Some Vehicles in Fantasy range contain onboard closed circuit recording device/s.

YOUR SAFETY FIRST: SEAT BELTS, BABY SEATS Your safety while travelling with us is of paramount importance to us. For this reason, we will gladly supply a baby seat for your infant (on prior request). We advise it is compulsory to wear our vehicles fitted seat belts at all times. The law states that the wearing of fitted seat belts is compulsory at all times and we are in adherence with this. Our Chauffeurs who are in a separatecabin to the passenger will be unable to monitor this adherence and are not there to Police this. The Chauffeur cannot give you authority no to wear a seat belt, so please do not ask. We have a $10M Public Liability Policy per vehicle which state seat belts must be worn in its Policy Guidelines.

VARIATION OF TERMS None of the above terms may be varied or altered by any of our staff, except where in express written form.
